Cops Are Asking You Questions. Do you know what to do?




What are your rights in an encounter with the police? Does it matter if you are under 18? What should you do?

To make a long story short, your best bet is to not answer any questions. You have the right under the 5th Amendment to our constitution to not answer any questions. You have a right to not agree to any searches and/seizures of your property. And unless they can articulate what crime you are being suspected of, you are not required in most situations to show identification.

Yes, these rights do apply to those under 18. The Supreme Court has ruled in many cases that the rights offered to people over the age of 18 also apply to minors. Now of course, police can and will lie to minors telling them that they don't have any rights because they are underage. Simply not true.

In re Gault was a 1967 Supreme Court case that concluded that the due process clause of the 14th Amendment applies to juveniles in criminal cases.
